ABSTRACT

This article focuses on the main categories of legal relationships between the public partner and the private partner when realizing the projects of public – private partnership with focus on description of primary and secondary nature of such relationships. Further the article deals with the recent development of legal obligations of the public partner in the process of public procurement where the public partner has the obligation to publish all contracts, concluded with the private partner upon the results of public procurement in the way and under the conditions set by the Civil Code and other related laws and regulations.
